A. Procedure for Reporting Intellectual Property Infringement

Bags N More takes intellectual property rights seriously. Upon receiving a sufficiently detailed complaint, we will review the reported content and determine what action, if any, may be appropriate.

Our standard procedure is to investigate and, where appropriate, rectify or otherwise address the reported intellectual property issue within three (3) business days of receiving sufficient information to evaluate the matter.

To report an alleged intellectual property infringement, please provide the following information:

  1. Identification of the Intellectual Property
    Identify the copyrighted work, trademark, brand, or other intellectual property that you believe has been infringed. Where applicable, include registration numbers or other identifying information.

  2. Identification of the Allegedly Infringing Content
    Provide a description of the content that you believe infringes your intellectual property rights and explain how it allegedly infringes those rights. Please also provide enough information for us to locate the content on the Bags N More website.

  3. Your Contact Information
    Provide your full name, mailing address, telephone number, and email address.

  4. Good-Faith Statement
    Include a statement confirming that you have a good-faith belief that the disputed use of the intellectual property is not authorized by the intellectual property owner, its authorized representative, or applicable law.

  5. Accuracy and Authority Statement
    Include a statement, made under penalty of perjury where applicable, that the information contained in your notice is accurate and that you are the intellectual property owner or are authorized to act on behalf of the owner.

  6. Signature
    Provide an electronic or physical signature of the person authorized to act on behalf of the intellectual property owner.

Incomplete or insufficient notices may require additional information before the matter can be properly evaluated.


B. Action Following Receipt of a Valid Infringement Notice

After receiving a sufficiently detailed infringement notification, Bags N More may, where appropriate:

  1. Review the reported content and information provided;

  2. Remove or disable access to allegedly infringing content where appropriate;

  3. Notify the person or party responsible for the content, where appropriate;

  4. Request additional information or documentation when necessary;

  5. Take other measures that may be appropriate under applicable law; and

  6. Take appropriate action against repeat infringers.

Bags N More will generally seek to investigate and, where appropriate, rectify or otherwise address a reported intellectual property issue within three (3) business days after receiving sufficient information to evaluate the matter.


C. Counter-Notification Procedure

If content has been removed or access to content has been restricted because of an intellectual property complaint, the affected party may submit a counter-notification if they believe the removal was made in error, the content is not infringing, or they otherwise have the legal right to use the content.

A counter-notification should include:

  1. Identification of the Removed Content
    Identify the content that was removed or disabled and describe where the content appeared on the Bags N More website before it was removed or disabled.

  2. Good-Faith Statement
    Include a statement confirming that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification.

  3. Contact Information
    Provide your full name, mailing address, telephone number, and email address.

  4. Jurisdiction and Service Statement
    Where required by applicable law, include a statement consenting to the jurisdiction of the appropriate federal court and agreeing to accept service of process from the party who submitted the original infringement notification.

  5. Signature

Upon receiving a valid counter-notification, Bags N More may provide a copy of the counter-notification to the original complaining party and may take further action in accordance with applicable law.

Where the Digital Millennium Copyright Act (DMCA) applies, restoration of removed content may be subject to applicable statutory requirements and procedures.


D. Repeat Infringers

Bags N More may take appropriate action against users or other parties who repeatedly infringe the intellectual property rights of others.

Depending on the circumstances and applicable law, such action may include removing or disabling access to infringing content, restricting account activity, or suspending or terminating access to applicable Bags N More services.


E. Misrepresentation

Please ensure that all information submitted in an intellectual property complaint or counter-notification is accurate and complete.

Under Section 512(f) of the U.S. Digital Millennium Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Bags N More reserves the right to take appropriate action against parties who knowingly submit fraudulent, misleading, or abusive infringement claims.
